A Consumer<\/strong> is an individual acting primarily for personal purposes and not in the course of a trade, business, or profession. <\/p>\n\n Before or when an agreement is entered into, these Terms and Conditions will be made available to the Customer in a format that can be read and saved.<\/p>\n\n If additional terms apply to a particular product or service, such as the License Terms, those additional terms will take precedence over these Terms and Conditions to the extent that they address the same subject matter.<\/p>\n\n The Curious Mind Expedition offers, among other things:<\/p>\n\n The content, scope, price, and any specific conditions are stated with the relevant product or service.<\/p>\n\n An agreement is formed after the Customer has placed an order and payment has been successfully received by The Curious Mind Expedition.<\/p>\n\n Digital products are delivered by email, download link, or other form of digital access. After successful payment, the Customer will receive access to the product in the manner described in the offer or during the checkout process. <\/p>\n\n Digital products are provided in the file format stated with the product. The Customer is responsible for having suitable equipment and software to open, download, and store the file and for providing accurate contact information. <\/p>\n\n If a digital product has not been received or a download does not work, please contact hello@thecuriousmindexpedition.com<\/strong><\/a>. <\/p>\n\n Consumers in the European Union, the United Kingdom, and certain other jurisdictions may have a statutory right to cancel a distance contract within a specified period, which is generally 14 days in the EU and UK.<\/p>\n\n For digital content that is supplied immediately, such as downloads, this statutory right may be lost. Before placing an order, the Consumer is therefore asked to expressly consent to the immediate supply of the digital content and to acknowledge that the applicable right of withdrawal or cancellation will be lost once supply begins. <\/p>\n\n Once the Consumer has given this consent and the supply of the digital content has begun, the purchase can no longer be canceled or returned on the basis of that statutory withdrawal right, and a refund cannot be requested on that basis. Nothing in this section affects any statutory rights a Consumer may have if a digital product is not supplied correctly, is defective, or does not conform to the agreement.<\/p>\n\n All learning programs, worksheets, guides, posters, downloads, images, text, activities, designs, and other materials provided by The Curious Mind Expedition are protected by copyright and remain the intellectual property of The Curious Mind Expedition.<\/p>\n\n When purchasing a digital product, the Customer receives a license to use the product. No copyright or other ownership rights are transferred to the Customer. <\/p>\n\n Materials may only be used within the limits of the license purchased. Among other things, materials may not be: <\/p>\n\n The specific usage rights, restrictions, license types, license periods, and rules regarding sharing, modifying, and using the materials are set out in the separate License Terms of The Curious Mind Expedition<\/a><\/strong>. The License Terms form part of the agreement and are made available before the order is placed. <\/p>\n\n Materials, downloads, and sample lessons provided free of charge also remain protected by copyright. These Terms and Conditions and, where stated to apply, the License Terms also apply to their use. <\/p>\n\n All prices are displayed in euros.<\/p>\n\n The total price and any applicable taxes or other charges will be clearly displayed before the Customer places an order.<\/p>\n\n The Curious Mind Expedition may change its prices. Price changes do not affect agreements that have already been entered into. <\/p>\n\n Payments are made using the payment methods offered during checkout and are currently processed through Mollie.<\/p>\n\n The Curious Mind Expedition develops its materials with care. However, no guarantee is made that using the materials will result in specific learning outcomes, educational results, or other outcomes. <\/p>\n\n The materials are educational resources. The user remains responsible for how the materials are used and for determining whether a particular resource is suitable for the relevant student, group, or situation. <\/p>\n\n If a digital product does not conform to the agreement, Consumers retain any rights and remedies available to them under applicable law.<\/p>\n\n The Curious Mind Expedition is not liable for loss or damage resulting from improper use of the materials, use contrary to the instructions or License Terms, or circumstances that cannot reasonably be attributed to The Curious Mind Expedition.<\/p>\n\n To the extent permitted by applicable law, the liability of The Curious Mind Expedition is limited to the amount paid for the relevant product or service. Additional terms may apply to workshops, presentations, webinars, educational guidance, or other additional services, for example regarding content, date, location, price, payment, and cancellation.<\/p>\n\n These arrangements will be agreed with the Customer before the agreement is entered into. If specifically agreed terms differ from these Terms and Conditions, the specifically agreed terms will apply to the extent permitted by law. <\/p>\n\n The Curious Mind Expedition processes personal data in accordance with the Privacy Policy of The Curious Mind Expedition<\/strong><\/a>.<\/p>\n\n The Privacy Policy explains, among other things, what personal data is processed, why it is processed, with whom it may be shared, how long it is retained, and what privacy rights individuals have.<\/p>\n\n If you have a question or complaint about an order, product, or service, please contact hello@thecuriousmindexpedition.com<\/strong><\/a>. <\/p>\n\n The Curious Mind Expedition aims to respond to questions and complaints within a reasonable period and, where possible, to work with the Customer toward an appropriate solution.<\/p>\n\n Any statutory consumer rights remain unaffected.<\/p>\n\n These Terms and Conditions and agreements with The Curious Mind Expedition are governed by the laws of the Netherlands.<\/p>\n\n If the Customer is a Consumer, this choice of law does not deprive the Consumer of any mandatory consumer protection provided by the laws that would otherwise apply to the Consumer, including mandatory protections in the Consumer’s country of habitual residence where applicable.<\/p>\n\n Disputes will be submitted to the competent courts in the Netherlands, unless mandatory applicable law provides that another court has jurisdiction.<\/p>\n\n If any provision of these Terms and Conditions is found to be wholly or partially invalid or unenforceable, the remaining provisions will remain in effect.<\/p>\n\n The Curious Mind Expedition may update these Terms and Conditions, for example due to changes in its services or changes in applicable laws and regulations.
